NOTICE OF CLASS ACTION AND PROPOSED SETTLEMENT

A court authorized this notice. You are not being sued. This is not a solicitation from a lawyer.
 
A proposed Settlement has been reached in a class action lawsuit called Lipsky, et al. v. American Behavioral Research Institute, LLC, d/b/a Relaxium, Case No. 50-2023-CA-011526-XXXX-MB, pending in Palm Beach County Circuit Court, Florida, which alleges that American Behavioral Research Institute, LLC (“Defendant” or “ABRI”) engaged in deceptive and misleading business practices regarding the efficacy and automatic billing practices of Relaxium® (hereinafter, the “Products”).

You are included in the Settlement if you purchased the Products for personal use between January 23, 2019 and July 27, 2023.

ABRI will make certain revisions to its auto shipment programs, and its marketing and advertising of the Products. ABRI will also provide up to a maximum of $1,300,000.00 in payments to individuals who purchased the Products as well as other fees and expenses. Settlement Class Members can submit a claim for a cash payment of $9.00 per household, subject to pro rata adjustment. See Question 6 in the Frequently Asked Questions for more details.

Your legal rights are affected even if you do nothing. Read this Notice carefully.

Legal Rights & Options

Submit a Claim

You must submit a Claim to get money from this Settlement. Claim Forms must be submitted online or postmarked by October 9, 2023.

Do Nothing

If you do nothing, you remain in the Settlement, you give up your rights to sue, and you will not get any money.

Exclude Yourself

Get out of the Settlement. This is the only option that allows you to keep your right to sue Defendant about the claims in this lawsuit. You will not get any money from the Settlement and cannot file an objection about the Settlement. Your request to exclude yourself must be postmarked by October 9, 2023.

File an Objection

Stay in the Settlement but tell the Court why you think the Settlement, or some aspect of the Settlement, should not be approved. Objections must be submitted by October 9, 2023.

Go to a Hearing

You can ask to speak in Court about the fairness of the Settlement, at your own expense.  See Question 18 in the Frequently Asked Questions for more details. The Fairness Hearing is scheduled for October 17, 2023.
